On October 24, 2018, President Trump signed into law U.S. House of Representatives Bill 6 ("H.R. 6"), cited as the "Substance Use-Disorder Prevention that Promotes Opioid Recovery and Treatment for Patients and Communities Act," and known as the "SUPPORT for Patients and Communities Act."
Among other things, H.R. 6 amends the federal Sunshine Act definition of "covered recipient" to include:
Currently, the definition of "covered recipient" only includes physicians and teaching hospitals.
The expanded definition will apply to "information required to be submitted...on or after January 1, 2022." H.R. 6 does not specify whether the amendments apply to data capture during calendar year 2021 or calendar year 2022.
